ORDINANCE NO. 824

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THECITY OF NEWCASTLE BY AMENDING TITLE XV, (LAND USAGE), CHAPTER 153, (SUBDIVISIONS), SECTION. 153.016; (DEFINITIONS, THE DEFINITION OF “PLAT REVIEW TEAM”); BY REPLACING THE EXISTING SECTION 153.016 WITH THAT SET FORTH BELOW; AND FURTHER AMENDING THE CODE OF ORDINANCES OF THE CITY OF NEWCASTLE BY DELETING SECTION 37.04 (SUBDIVISION REVIEW COMMITTEE) FROM TITLE III (ADMINISTRATION) CHAPTER 37(BOARDS, COMMITTEES, COMMISSIONS AND DEPARTMENTS)REPEALING ALL OTHER CONFLICTING PROVISIONS; PROVIDING FOR SEVER-ABILITY; AND DECLARING AN

EMERGENCY

EMERGENCY ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEWCASTLE,OKLAHOMA:

That, Title XV, Chapter 153, Section 153.016; Definitions (Plat Review Team), of the City Code of the City of Newcastle shall be amended to read in its entirety as follows: SECTION I. PLAT REVIEW TEAM.

(a) The Plat Review Team shall consist of the following, to-wit:

(i) Community Development Director who shall act as Chairperson;

(ii) Planning Commission Chairman;

(iii) City Engineer;

(iv) City Water Superintendent;

(v) City Sewer Superintendent;

(vi) City Street Superintendent;

(vii) City Manager or his/her designee;

(viii) Police Chief;

(ix) Fire Department Chief; and

(x) City Inspector.

(b) The Mayor may also, at his/ her option, appoint one member of the City Council as an ex officio member of this team.

(c) It shall be the responsibility of the Plat Review Team to meet together, on call of the City Manager, to review pre-application plans and preliminary plats of any proposed development for the purposes for which it is intended and to submit their findings and recommendations to the Planning Commission.

SECTION II.

That Title III, Chapter 37 is amended by deleting in its entirety € 37.04(Subdivision Review Committee).

SECTION III. REPEALER

All ordinances or parts of ordinances in conflict herewith are hereby repealed.

SECTION IV. SEVERABILITY

If any part of this Ordinance shall be held to be invalid or ineffective, the remaining portions shall not be affected.

SECTION V. EMERGENCY Whereas, it being immediately necessary for the preservation of the peace, health, welfare and safety of the City of Newcastle, Oklahoma and the inhabitants thereof that the provisions of the ordinance be put into full force and effect, an emergency is hereby declared to exist by virtue hereof; this ordinance shall be in full force and effect from and after its approval, passage and publication. NO 814 PASSED BYTHE NEW-CASTLE CITY COUNCIL ON JUNE 11, 2018, AND ORDINANCENO. 815 PASSED BY THE NEWCASTLE CITY COUNCIL ON

ORDINANCES AMENDED THE

CODE OF ORDINANCESOF NEWCASTLE AND SPECIFICALLY

TITLE XI, (BUSINESS REGULATIONS), CHAPTER 113, (OIL AND GAS DRILLING); AND REPEALING ALL OTHER CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY; AND DECLARING

AN EMERGENCY

EMERGENCY ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEWCASTLE,OKLAHOMA: That Ordinance No. 814, and Ordinance No. 815,Title XI, Chapter 113, are amendedas follows: Section 1: The following sections of Ordinance No. 814 and Ordinance No. 815 (Chapter 113 of the Newcastle Code or Ordinances) are amended to read in their entirety as follows, to-wit: (A) SECTION 113.02. FINDINGS, PURPOSE, INTENT AND AUTHORITY, Subsection A(5) shall read as follows:

(5) The city recognizes that the State of Oklahoma Corporation-Commisson regulates oil and gas well drilling productionactivities.

The regulations in this article

are intended to supplement

such standards and additionally implement compatible local measures that assure the health, safety and general welfare of the city’s residents and businesses.

(B) SECTION 113.53 ORDER TO TEMPORARILY SUSPEND OPERATIONS Subparagraph A is amended and shall read as follows: (A) If the City Manager or his designee finds that, in his judgment,

a hazard to life exists, he shall order immediate rectification of the cause. If the permittee takes no immediate measure to reduce

the hazard, or the situation is

so perilous as to constitute an imminent threat to safety, then in either of these events he/she may order the prompt suspension of activity, and if necessary the clearance of all non-essential

personnel from the premises.

(C) SECTION 113.103 ENVIRONMENTAL REQUIREMENTS AND PERFORMANCE STANDARDS is amended to reflect the Section Noto. be Section 113.04 and further amended to reflect that the heading is ENVIRONMENTAL REQUIREMENTS AND RECOMMENDED PRACTICES.

(D) SECTION 113.104 ENVIRONMENTAL REQUIREMENTS AND RECOMMENDED PRACTICES, Subparagraph A is amended and shall read as follows: (A) All oil operations, drilling and production operations shall be conducted in such a manner as to eliminate, as far as practicable, dust, noise, vibration or noxious odors, and shall be in accordance with the American Petroleum Institute recommended practices incident to exploration for, drilling for and production of oil, gas and other hydrocarbon substances. Proven technological improvements in exploration, drilling and production methods shall be adopted as they become from time to time available, if capable of reducing factors of nuisance and annoyance. (E) SECTION 113.104 ENVIRONMENTAL REQUIREMENTS AND RECOMMENDED PRACTICES, Subsection c is amended to read as follows:

(c) The motor power for all well drilling equipment shall meet the noise requirements set forth in Ordinance No. 814(Chapter113) of the Newcastle Code of Ordinances.

(F) SECTION 113.107 STANDARDS FOR OIL AND GAS WELL DRILLING AND GAS WELL PRODUCTION, Subparagraph d is amended to read as follows:

(d) The motor power for all well drilling equipment shall meet the noise requirements set forth in Ordinance No. 814 (Chapter113) of the Newcastle Code of Ordinances.

(G) SECTION 113.105 MITIGATION AND RESTORATION PLANS paragraph A, last paragraph is amended and shall read as follows: No conditional use permit shall be issued until a drilling/completion mitigation plan is submitted to, and approved by, the city council. SECTION II. REPEALER All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION III.
