ORDINANCE NO. 1016
AN ORDINANCE OF THE CITY OF NEWCASTLE, OKLAHOMA, AMENDING THE NEWCASTLE CODE OF ORDINANCES, TITLE V (PUBLIC WORKS); CHAPTER 50 (GENERAL UTILITY PROVISIONS); SECTION 50.10 (DITCHING PERMIT); DESIGNATING REQUIREMENTS FOR PERMITS; REQUIRING BONDS OR OTHER SECURITY; AND ESTABLISHING PERMIT FEES FOR UTILITY/DITCHING, TRENCHING, BORING AND INSPECTIONS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEWCASTLE, OKLAHOMA:
SECTION I: AMENDMENT.
Title V, Chapter 50, §50.10 of the Newcastle Code of Ordinances, be and is hereby amended to be read in its entirety as follows:
“§ 50.10 DITCHING PERMIT.
(A) It shall be unlawful for any person, firm or corporation to initiate any ditching operation involving any public easement or right-of-way within the city without first obtaining an approved Utility Right-of-Way/Boring Permit from the Public Works/Street Department.
(B) The permit shall be issued only if the applicant meets the following conditions:
(1) The applicant shall provide a map of the proposed project to the Public Works and Street Department prior to initiating work. The map shall show scope of all work to be completed and all areas of public easement, right-of-way or places, areas or buildings potentially affected by the proposed project.
(2) The applicant shall agree to comply with the Underground Utility Damage Prevention Act and must contact OKIE811 with utility lines flagged or marked prior to initiating work.
(3) The applicant shall provide a surety bond or cash deposit, suitable to the city, as to dollar amount and form, to insure cost of repair of any damage. Upon completion of the project, the city will review any damage claims and require the contractor to make appropriate arrangements to repair any damage to property wherever situated, defect in workmanship or materials, or other inspection deficiency.
(4) In all cases where the surface of the street, alley, sidewalk or other public ground is disturbed, the party so cutting into the opening shall maintain suitable barricades and shall place lights at night to protect persons and property from danger.
(C) Violation of any of these provisions shall be grounds for revocation of the applicant’s permit at any time.
(D) The permit application fee shall be $100 for utility/ditching and/or trenching, and $200 for boring, plus a $50 inspection fee and additional $20 inspection fee per bore.
SECTION II: REPEALER.
All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
SECTION III: SEVERABILITY.
If any part of this Ordinance shall be held to be invalid or ineffective, the remaining portions shall not be affected.
SECTION IV: EMERGENCY.
WHEREAS it being immediately necessary for the preservation of the peace, health, welfare and safety of the City of Newcastle, Oklahoma, and the inhabitants thereof that the provisions of this Ordinance be put into full force and effect, an emergency is hereby declared to exist by virtue hereof; this Ordinance shall be in full force and effect from and after its approval, passage and publication.

ORDINANCE NO. 1017
AN ORDINANCE OF THE CITY OF NEWCASTLE, OKLAHOMA, AMENDING THE NEWCASTLE CODE OF ORDINANCES, TITLE IX (GENERAL REGULATIONS); CHAPTER 93 (STREETS AND SIDEWALKS); SECTION 93.05 (PAVEMENT CUTTING PERMITS); DESIGNATING REQUIREMENTS FOR PERMITS; REQUIRING BONDS OR OTHER SECURITY; AND ESTABLISHING PERMIT FEES FOR UTILITY/DITCHING, TRENCHING, BORING AND INSPECTIONS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEWCASTLE, OKLAHOMA:
SECTION I: AMENDMENT.
Title IX, Chapter 93, §93.05 of the Newcastle Code of Ordinances, be and is hereby amended to be read in its entirety as follows:
§ 93.05 PAVEMENT CUTTING PERMITS.
(A) (1) No person or entity shall cut, dig or remove by any other means, any portion of any sealed surface street located within the city without an approved Utility Right of Way/Boring Permit with required application fees, construction plans and specifications, and submittal of bonds or a cash deposit for work performed under the permit.
(2) The city may authorize a private contractor to work on or bore beneath the streets of the city with an approved permit.
(B) Any plumber or other person desiring to cross under any public street, alley, sidewalk or other public ground, whether paved, graveled, graded or not, in the city for any purpose, shall first obtain a permit from the Public Works/Streets Department and, where economically feasible, shall cross under the same by boring under the public street, alley, sidewalk or other public ground. All work within the permitted project right-of-way shall be governed under a single Utility Right-of-Way Permit.
(C) To cross under any public street, alley, sidewalk or other public ground in the city, as set out hereinabove, upon prior approval given by the Streets/Public Works Department, any plumber or other person desiring to cut into or in any manner open any public street, alley, sidewalk or other public ground, whether paved, graveled, graded or not, in the city, for any purpose, shall first obtain a permit from the Public Works/Streets Department to cut or open the street, alley, sidewalk or other public ground. Compliance with Oklahoma Underground Facilities Damage Prevention Act is required.
(D) Prior to the issuance of a permit as required herein, the applicant shall provide a surety bond or cash deposit, suitable to the city as to dollar amount and form, insuring the cost of repair of any damage. Upon completion of the project, the city will review any damage claims and require the contractor to make appropriate arrangements to refill and repair the requested cut or opening in accordance with the requirements of subsections (I) through (K) below. All deposits shall be made to the city and shall be held in a special fund. The deposit shall be released to the permit holder upon certification by the Streets/Public Works Department that refilling and repairing of the cut or opening has been performed in accordance with the requirements of divisions (F) through (K) below.
(E) It shall be the duty of the permit holder to comply with the provisions of divisions (D) and (E) above and (I) through (K) below and all work required shall be completed immediately. A person with approved credentials, for effective communication with City of Newcastle employees, is required on-site at all times or a risk of being “shut down” will apply until an approved person is appointed and on-site, pursuant to OSHA standards found at Title 29 CFR §1926.32.
(F) After satisfactory refill and repair as required by divisions (I) through (K) below, it shall be the responsibility of the permit holder to immediately perform any and all subsequent refill, repair and maintenance on the cuts or openings for a period of 12 months from the date of the permit, upon notice from the Streets Department.
(G) Upon failure of the permit holder to make adequate refill and repair as required by this subchapter, the city may refill or repair or secure the work by contract, with the cost of the work being assessed against the permit holder. Failure of the permit holder to pay costs shall be grounds for denial of any and all future permits required by divisions (D) and (E) above, and the permit holder shall be subject to all other penalties provided for in this chapter.
(H) When any street, alley, sidewalk or other public ground has been cut or opened for any purpose, the permit holder shall refill and repair the cut or opening, pursuant to the construction plans and specifications.
(I) All surfaces shall be restored with similar materials and workmanship as originally existed prior to the cut or opening and shall be subject to the approval of the Streets Department.
(J) All dirt and other materials taken from the cut or opening shall be hauled away by the permit holder.
(K) In all cases where the surface of the street, alley, sidewalk or other public ground is disturbed, the party so cutting into the opening shall maintain suitable barricades and shall place lights at night to protect persons and property from danger.
(L) The permit application fee shall be $100 for utility/ditching and/or trenching, and $200 for boring, plus a $50 inspection fee and additional $20 inspection fee per bore.
