SOLICITATION AND
NOTICE FOR BIDS

Nabholz Construction Corporation (NCC) will be opening sealed bids for construction of the NEWCASTLE ECC/MS ROAD IMPROVEMENTS project for Newcastle Public Schools (hereafter known as “Owner”) in Newcastle, OK.  Bids will be received and publicly read aloud at 2:00 P.M. on April 7th, 2026 at Newcastle Public Schools Administration Building located at 101 N. Main St., Newcastle, OK 73065.

A copy of the bid documents, including the drawings, specifications, CM Manual, Bid Instructions, and Bid Forms may be obtained from Randy Knight and Dylon Mallett, Nabholz Construction 301 NW 13th Street, Suite 104 Oklahoma City, OK 73103 (405) 245-4995 / (405) 766-0159. Please direct all questions to Randy Knight and Dylon Mallett, NCC.  Deadline for questions shall be 2:00 P.M. on March 31st, 2026.

Pre-bid meeting will be held at Newcastle Early Childhood Center in the east parking lot located at 251 NE 2nd S, Newcastle, OK 73065 on March 16th , 2026, at 10 A.M. Attendance is highly recommended for all bidders. Bidders shall not visit jobsite outside of pre-bid meeting due to school being in session.

All Bids must be submitted on Nabholz Bid Form, to include all Affidavits (Refer CM Manual), to be considered responsive.  All bids totaling $50,000 or over must be accompanied by bid security in the form of certified or cashier’s check or a Bid Bond in the amount of five percent (5%) of amount of bid. Upon approval by the Owner of acceptable bids, a Letter of Intent to contract or written contract will be awarded within forty-five (45) days after the opening of qualified, responsive bids.  All bid amounts must be held and guaranteed through the entire forty-five (45) day post-bid award period. NCC will retain bid security and, at Owner’s option, use it for liquidated damages in case successful bidder fails to enter into contract and furnish required bonds within seven (7) days of receipt of contract.

Bids must be hand delivered in properly sealed envelopes (no more than 1 hour prior to bid time), and clearly marked with Project Name and Bid Package, to bid opening location at aforementioned address. Sealed bids may also be mailed to Nabholz OKC Office located at 301 NW 13th Street, Suite 104, Oklahoma City, OK 73103. Mailed bids must arrive no later than 5:00 PM on April 6th, 2026, and be addressed to the attention of Randy Knight or Dylon Mallett. Mailed bids are at the risk of the bidder.

NCC and Owner reserve the right to reject any or all bids and to waive informalities or minor irregularities in any bid in accordance with OK Competitive Bidding Act.

ORDINANCE NO. 1015

AN ORDINANCE OF THE CITY OF NEWCASTLE, OKLAHOMA, AMENDING THE NEWCASTLE CODE OF ORDINANCES, TITLE XV (LAND USAGE); CHAPTER 34 (PLANNING AND ZONING); SECTION 154.099 (SWIMMING POOLS); BY CLARIFYING SUBSECTION 154.099(A) REGARDING CONSTRUCTION OF SWIMMING POOLS AND FENCING REGULATIONS IN ALL ZONING DISTRICTS; AND ADDING A NEW SUBSECTION 154.099(C) ESTABLISHING PROCEDURES FOR A SPECIAL EXCEPTION APPLICATION TO THE BOARD OF ADJUSTMENT FOR SWIMMING POOLS IN THE AGRICULTURAL DISTRICT OR PARCELS OF TWO (2) ACRES OR MORE IN SIZE IN ANY ZONING DISTRICT, AND PROVIDING FOR NOTICE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEWCASTLE, OKLAHOMA:

SECTION I: AMENDMENT.

The Newcastle Code of Ordinances, Title XV (Land Usage); Chapter 34 (Planning and Zoning); Section 154.099 (Swimming Pools), be and is hereby amended by clarification of Subsection (A) relating to fences for private swimming pools in all zoning districts; and is further amended by adding a new Subsection (C) establishing procedures for application to the Board of Adjustment for a Special Exception for swimming pools in the Agricultural district or for swimming pools in parcels of two (2) acres or more in any zoning district; and shall henceforth read in its entirety as follows:

 § 154.099 SWIMMING POOLS.

(A) Private swimming pools may be constructed as an accessory use in any zoning district but shall be completely enclosed by a permanent wall or fence not less than four feet in height and shall meet the requirements of the County Health Department.

(B) No swimming pool or any portion of the pool equipment, walkway or other facilities related thereto, shall be located closer than ten (10) feet to a side or rear lot line.

(C) Owners of property zoned Agricultural, or of parcels that are two (2) acres or more in size in any other zoning district, may apply for a Special Exception from the provisions of Subsections (A) or (B) or both, requesting a Special Exception to be determined by the Board of Adjustment under Section 154.145(C)(4) after following the notice procedures set forth in Section 154.147.  
 
SECTION II: REPEALER.

All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.

SECTION III: SEVERABILITY.

If any part of this Ordinance shall be held to be invalid or ineffective, the remaining portions shall not be affected.

SECTION IV: EMERGENCY.

WHEREAS it being immediately necessary for the preservation of the peace, health, welfare and safety of the City of Newcastle, Oklahoma, and the inhabitants thereof that the provisions of this Ordinance be put into full force and effect, an emergency is hereby declared to exist by virtue hereof; this Ordinance shall be in full force and effect from and after its approval, passage, and publication.  

PASSED, APPROVED AND ADOPTED by the Council of the City of Newcastle, Oklahoma, on the 9th day of March 2026.
